Nature of TikTok "Gifts":

For purposes of TikLink's service, TikTok "gifts" are treated solely as virtual engagement metrics and viewer interaction data points. TikLink does not process, handle, or have any involvement with the financial transactions underlying these gifts, which are managed exclusively by TikTok/ByteDance. TikLink displays publicly available data only and does not operate as a payment processor, financial intermediary, or auction platform.

Exception - Islamic Content Violations (Refundable):

If your account is permanently banned solely due to violations of our Islamic content standards (Section 5, 6, or 7), and TikLink determines in its sole discretion that the violation is content-related (not fraud or scam), you will receive a full refund of your current month's subscription. This refund policy only applies to bans related to inappropriate content, not to technical violations, fraud, chargebacks, or other non-content related breaches. TikLink's determination of whether a violation qualifies for refund is final and non-appealable.

Content Moderation:

We reserve the right to immediately suspend or terminate accounts found to be streaming inappropriate content that violates these standards. This includes but is not limited to content featuring immodest clothing, sexual themes, prohibited substances, or any material inconsistent with Islamic ethical principles.

Note:

While we provide the technical platform, users are responsible for ensuring their content, business practices, and revenue sources comply with Islamic law. This includes verifying that auction items, donations, and viewer interactions are permissible and ethical. TikLink is not responsible for gift refunds, viewer disputes, or any conflicts between creators and their audience. Creators must communicate clearly that TikTok gifts sent during streams are processed by TikTok and are non-refundable. Failure to properly inform viewers may result in account suspension.

⚠️ TIKLINK'S ABSOLUTE DISCRETION TO DETERMINE VIOLATIONS

TikLink has sole, exclusive, final, and absolute discretion to determine:

• 1. Whether your conduct constitutes "Fraud/Scam" (non-refundable) OR "Content Violation" (refundable)
• 2. The severity, intent, and categorization of any Terms violation
• 3. Whether evidence demonstrates deceptive intent or mere content policy breach
• 4. The appropriate remedy (warning, suspension, ban, with or without refund)

🔒 CLASSIFICATION IS FINAL: TikLink's determination is binding, non-appealable, and cannot be contested through customer support, chargebacks, or legal proceedings. You agree to accept our classification without challenge.

⚠️ IMPORTANT - READ CAREFULLY

If we detect that you are using TikLink to scam, defraud, or deceive your viewers, your account will be immediately and permanently banned with NO REFUND.

Scam activities include but are not limited to:

• ✗ Running fake auctions with no intention of delivering items
• ✗ Accepting donations/gifts under false pretenses (fake charity, fake emergencies, etc.)
• ✗ Manipulating viewers into sending gifts through deception or lies
• ✗ Failing to deliver promised auction items or services after payment
• ✗ Creating fake personas or identities to manipulate viewers
• ✗ Using bots or fake accounts to artificially inflate engagement
• ✗ Any other dishonest practice intended to defraud viewers or TikLink

Consequences of Scam Detection:

• • IMMEDIATE PERMANENT BAN - No warnings, no second chances
• • NO REFUND - You forfeit all subscription fees paid
• • PERMANENT BLACKLIST - You cannot create new accounts
• • POSSIBLE LEGAL ACTION - We may report fraud to authorities

By using TikLink, you acknowledge that scamming is a serious violation that will result in permanent ban without refund. We have zero tolerance for fraudulent behavior and prioritize protecting the community over individual profit.

⚠️ IMPORTANT - WHAT TIKLINK DOES NOT DO:

TikLink does not operate, host, or provide any auction service, contest platform, or reward distribution system. Any auction-like mechanics, rankings, contests, or viewer rewards are entirely created, managed, and executed by the user (streamer) within their own TikTok livestream using their own rules and discretion.

TikLink does NOT:

• ✗ Operate or facilitate auctions, lotteries, or contests
• ✗ Determine winners, enforce rules, or validate contest results
• ✗ Process payments, handle financial transactions, or act as a payment intermediary
• ✗ Guarantee delivery of items, services, or rewards promised by streamers
• ✗ Mediate disputes between streamers and viewers
• ✗ Validate, verify, endorse, or take responsibility for any streamer activities
• ✗ Have any control over how streamers use the displayed data

The streamer is solely and exclusively responsible for creating, managing, and fulfilling any auction, contest, ranking system, or reward distribution they choose to implement. TikLink is merely a passive data visualization tool with no involvement in streamer-viewer interactions, transactions, or obligations.

IMPORTANT NOTICE:

TikLink is not affiliated with, endorsed by, or connected to TikTok or ByteDance Ltd. TikLink is an independent third-party service provider. All trademarks, service marks, and trade names of TikTok, TikTok Live, ByteDance, and related products and services are the property of their respective owners.

⚠️ IF YOU ORGANIZE AUCTIONS OR CONTESTS USING TIKLINK DATA, YOU ARE SOLELY RESPONSIBLE

While TikLink does not provide auction services, if you choose to organize auctions, contests, rankings, or reward systems using the data displayed by TikLink, you acknowledge and agree that:

• 1. You are the auction organizer, not TikLink. You create all rules, terms, and conditions.
• 2. You are responsible for legal compliance with all applicable laws (consumer protection, gambling, lottery, contest regulations, tax obligations, etc.)
• 3. You must fulfill all promises made to viewers (item delivery, prize distribution, refunds if applicable, customer service, etc.)
• 4. You bear all liability for disputes, fraud claims, chargebacks, legal action, or regulatory penalties
• 5. You must comply with TikTok's Terms of Service regarding monetization and viewer interactions
• 6. You indemnify TikLink (see Section 11bis) for any legal consequences arising from your auction activities

TikLink provides data visualization only. How you use that data is entirely your decision and responsibility. TikLink has zero involvement in your auctions and accepts zero liability for your actions.

⚖️ YOU AGREE TO INDEMNIFY AND HOLD HARMLESS TIKLINK

You agree to indemnify, defend, and hold harmless TikLink, its owners, employees, contractors, and affiliates from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees and legal costs) arising from or related to:

• • Your violation of these Terms of Service
• • Your violation of TikTok's Terms of Service, Community Guidelines, or any third-party policies
• • Your organization or execution of auctions, contests, lotteries, or reward systems using TikLink data
• • Your fraudulent, deceptive, or illegal activities (scams, false advertising, unfulfilled promises, etc.)
• • Disputes, chargebacks, or legal claims from your viewers or customers
• • Regulatory penalties or legal action taken against TikLink due to your conduct
• • Your streaming content, including intellectual property infringement or defamatory material
• • Any third-party claims arising from your use of TikLink

This indemnification obligation survives termination of your account and these Terms. You will reimburse TikLink for all legal fees, court costs, settlement amounts, and damages incurred defending claims caused by your actions.

Your Responsibilities:

• ✓ Comply with all TikTok policies and guidelines at all times
• ✓ Ensure your livestream content and activities are lawful
• ✓ Verify that your use of TikLink does not violate any third-party rights
• ✓ Obtain any necessary permissions or licenses for your activities
• ✓ Monitor changes to TikTok's policies and adjust your usage accordingly

Liability Disclaimer:

TikLink is not responsible for any sanctions, penalties, account suspensions, or bans resulting from your use of our service. If TikTok takes action against your account for policy violations, misuse, or any other reason, TikLink bears no liability and will not provide compensation, refunds, or recourse. You use TikLink at your own risk and must accept full responsibility for any consequences.

⚠️ FORCE MAJEURE - THIRD-PARTY SERVICE FAILURES

The following events constitute "Force Majeure" and completely exonerate TikLink from all liability, refunds, and service obligations:

• • Eulerstream or TikTok API outages, downtime, rate limiting, or service discontinuation
• • Changes to TikTok's API, policies, or Terms of Service that restrict or prevent TikLink functionality
• • TikTok blocking, banning, or restricting third-party integrations (including TikLink)
• • Data inaccuracies, delays, or errors caused by third-party data providers
• • Server outages, hosting provider failures, or infrastructure issues beyond TikLink's control
• • Government regulations, court orders, or legal requirements forcing service changes or shutdowns
• • Cyberattacks, DDoS attacks, or security incidents affecting third-party services

In the event of Force Majeure, TikLink is NOT liable for service interruptions, data loss, lost revenue, or any damages. TikLink is NOT obligated to provide refunds, compensation, or alternative solutions. We will make reasonable commercial efforts to notify users of known issues, but we cannot guarantee continuous operation when dependent on external services.

Acknowledgment:

By using TikLink, you acknowledge and accept that the service depends on third-party infrastructure beyond our control. You understand that TikLink cannot guarantee uptime, data accuracy, or uninterrupted service. You use TikLink at your own risk and agree that third-party failures are not TikLink's fault or responsibility.

🚫 Strictly Forbidden Activities

• ✗ Off-Platform Paid Auctions: Conducting paid auctions outside of TikTok's official gift system or requesting payments through external platforms (PayPal, Venmo, bank transfers, etc.)
• ✗ Gambling or Lotteries: Using TikLink to facilitate gambling, lotteries, games of chance, or any form of betting (prohibited under Islamic law and most jurisdictions)
• ✗ Resale or Redistribution of Data: Reselling, redistributing, or commercializing livestream data or TikLink's services to third parties
• ✗ TikTok Policy Violations: Using TikLink to violate TikTok's Community Guidelines, Terms of Service, or Creator Marketplace policies
• ✗ Data Scraping or Abuse: Extracting, scraping, or systematically collecting data from TikLink for unauthorized purposes
• ✗ Multi-Account Abuse: Creating multiple accounts to circumvent restrictions, bans, or subscription limits
• ✗ Reverse Engineering: Attempting to reverse engineer, decompile, or extract source code from TikLink
• ✗ Impersonation: Impersonating TikLink staff, other streamers, or misrepresenting your relationship with TikLink

No Liability for Service Changes:

TikLink shall not be liable to you or any third party for any modification, suspension, or discontinuation of the service. We are not obligated to provide refunds or compensation for interrupted service, lost data, or discontinued features. Users acknowledge that TikLink may need to make rapid changes or shut down services to comply with legal requirements, address security issues, or for business reasons beyond our control.

⚠️ CRITICAL LEGAL DISCLAIMER - READ CAREFULLY

TikLink is provided "AS IS" and "AS AVAILABLE" with ABSOLUTELY NO WARRANTIES of any kind, whether express, implied, statutory, or otherwise. We expressly disclaim all warranties, including but not limited to:

• ✗ Merchantability & Fitness for Purpose: No guarantee that the service will meet your specific needs, expectations, or business objectives
• ✗ Data Accuracy: No guarantee that TikTok data displayed is accurate, complete, current, or reliable
• ✗ Service Availability: No guarantee of uninterrupted, timely, secure, or error-free operation at any time
• ✗ Uptime Guarantees: No commitments regarding uptime percentages, service quality, or performance levels
• ✗ Third-Party Services: No guarantees regarding Eulerstream, TikTok API, or any external service reliability
• ✗ Security: No guarantee that the service is free from viruses, malware, security vulnerabilities, or unauthorized access
• ✗ Results: No guarantee of specific outcomes, viewer engagement, revenue generation, or business success

EXCLUSION OF DAMAGES - TIKLINK IS NOT LIABLE FOR:

UNDER NO CIRCUMSTANCES SHALL TikLink BE LIABLE FOR ANY OF THE FOLLOWING DAMAGES, EVEN IF TikLink WAS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES:

• ✗ Lost Profits & Revenue: Lost business opportunities, earnings, income, donations, TikTok gifts, or revenue streams
• ✗ Data Loss & Corruption: Loss, corruption, or inaccuracy of TikTok data, rankings, leaderboards, or historical records
• ✗ Service Interruptions: Downtime, outages, service suspensions, feature removals, or discontinued functionality
• ✗ Technical Malfunctions: Errors, bugs, glitches, crashes, security breaches, or software defects
• ✗ Third-Party Failures: Eulerstream outages, TikTok API changes, ByteDance policy violations, or external service disruptions
• ✗ Account Suspensions: TikTok account bans, TikLink bans, or loss of access to your account or data
• ✗ Reputational Harm: Damage to your reputation, brand, or relationship with viewers due to service issues
• ✗ Indirect/Consequential Damages: Any indirect, incidental, special, consequential, exemplary, or punitive damages of any kind
• ✗ Cost of Replacement Services: Costs incurred to obtain substitute goods, services, or technology
• ✗ Force Majeure Events: Any damages arising from events beyond TikLink's reasonable control (Section 13)

Jurisdictional Variations:

Some jurisdictions (including certain EU member states) do not allow the complete exclusion or limitation of liability for consequential or incidental damages. In such jurisdictions, TikLink's liability shall be limited to the greatest extent permitted by applicable law. However, the €22.50 / 3-month liability cap shall apply to the maximum extent legally enforceable.

Dispute Resolution:

Any legal disputes, claims, or controversies arising from these Terms or your use of TikLink shall be subject to the exclusive jurisdiction of the competent courts of Belgium. By using TikLink, you irrevocably consent to the jurisdiction and venue of these courts.

🛡️ TIKLINK'S ABSOLUTE DISCRETION IN VIOLATION CLASSIFICATION

TikLink has sole, exclusive, and final discretion to determine whether any Terms violation is categorized as:

• A. "Content/Ethical Violation" (Sections 5, 6, 7) - Inappropriate content, Islamic standards breach, immoral behavior → REFUNDABLE
• B. "Fraud/Scam Violation" (Section 8) - Deception, scams, dishonest practices, theft → NON-REFUNDABLE

⚠️ CRITICAL: TikLink's classification decision is FINAL, BINDING, and NON-APPEALABLE. Users cannot contest, dispute, or challenge this determination to obtain a refund. If TikLink determines your ban is fraud-related (even if you claim it's content-related), you will receive NO REFUND.

Examples of classification:

• ✓ Streaming inappropriate clothing while drunk → Content Violation (Refundable)
• ✗ Running fake charity auction to scam viewers → Fraud Violation (Non-refundable)
• ✗ Accepting gifts with fake promises of rewards → Fraud Violation (Non-refundable)

Permanent Ban for Content Violations (Refundable):

If your account is permanently banned for violations classified by TikLink as Content/Ethical violations (Sections 5, 6, or 7), and TikLink confirms this classification:

• • Your account will be immediately and permanently terminated
• • You will receive a full refund of your current month's subscription within 7-14 business days
• • You are prohibited from creating new accounts on TikLink
• • All access to our services will be permanently revoked

Important: This refund policy demonstrates our commitment to operating an ethical, halal platform. We would rather refund your payment than profit from content that violates Islamic principles. However, TikLink alone determines if your violation qualifies as "content-related."

⚠️ NO REFUND for Scam, Fraud & Dishonest Practices (Section 8):

If you are permanently banned for violations classified by TikLink as Fraud/Scam (Section 8), including but not limited to scamming, deception, fake auctions, unfulfilled promises, or any dishonest practices:

• ✗ You will receive NO REFUND under any circumstances
• ✗ All subscription fees paid will be forfeited immediately
• ✗ You cannot dispute the ban, appeal the classification, or request exceptions
• ✗ Chargeback attempts will incur a €35 administrative fee, permanent IP/device blacklist, and potential legal action

Scamming is theft. We do not refund thieves. This policy is non-negotiable and TikLink's fraud determination is absolute.
